The ninth circuit court has maintained a ban on sending national guard in Portland, Oregon, following a latest court ruling.

Appeals Court Agrees to Rehear Legal Matter

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the case concerning the executive power with an larger group of 11 judges. The judicial body also overturned a earlier ruling from a smaller judicial group that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the most recent turn in a protracted legal battle over whether the administration has the legal right and valid reason to deploy state military units in Portland. Approximately 200 federalized guard members have been in limbo since the end of September when the deployment effort was started in response to ongoing demonstrations.

Differing Viewpoints

The administration has argued that government employees at the immigration center in south Portland were facing threats, while local authorities maintain that municipal police have control of the circumstances.

In defiance of descriptions of the city as “war ravaged”, locals have been sharing footage of scenic paths and a thriving food scene, and planning events such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a US district judge in Portland issued two legal injunctions this period – one blocking the federal control of the Oregon national guard, and another prohibiting the use of any military personnel in the state, after efforts to evade the initial injunction by mobilizing troops from California.

On the previous day, the appeals court had temporarily suspended the initial decision – allowing control of state troops – but the second ruling remained in place, blocking the actual deployment of the forces.

Full Panel Consideration

The Tuesday decision means the issue will be heard by the full court – with all decisions under review together – by a panel of 11 judges.

“This ruling demonstrates that the truth matters and that the judicial system are striving to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a statement.

“The judicial body is sending a definite signal: the executive leader cannot send the military into US cities without cause. We will continue protecting state legislation, values, and autonomy as this legal proceeding moves forward and our legal battle continues in the judicial system.”
